These Terms and Conditions ("Terms") govern your access to and use of LinkHQ’s services, platforms, and tools, operated by Digievo Labs Private Limited, a company incorporated in India (“we,” “us,” “our”). By using LinkHQ, you agree to these Terms. If you do not agree, do not use our services.

1. Overview

LinkHQ is a super-app for creators, offering tools for monetization. Our services include:

• Online Stores: For selling digital and physical products.
• Appointment Booking System.
• Online Course Platform.
• Link-in-bio-tool.
• Seller dashboard for creators.

2. Eligibility

• Users must be at least 18 years old or meet the age of majority as defined by applicable laws.
• You are responsible for the accuracy of information provided during registration.

3. Roles and Responsibilities

For Creators (Sellers):

• Ensure that all claims, descriptions, and offerings related to your products or services are accurate and not misleading.
• Sellers must not sell any illegal items or violate any applicable laws or regulations.
• Abide by all applicable laws, including taxation and intellectual property regulations.
• Maintain a refund, cancellation, and delivery policy in compliance with laws.
• Collect, manage, and secure customer data responsibly.
• Sellers must follow all applicable tax laws. LinkHQ provides the software only and may charge Sellers for availing of the software services.

For Buyers:

• Verify the accuracy and authenticity of products or services offered by Sellers.
• Directly address any disputes or issues regarding purchases to the Seller.

LinkHQ is not responsible for verifying Seller claims or the quality of products/services offered.

4. Changes to Offerings

We reserve the right to modify, suspend, or discontinue any service, feature, or offering without prior notice.

5. Limitation of Liability

• LinkHQ is not liable for any content, products, or services offered by Sellers on the platform.
• We are not involved in disputes between Sellers and Buyers. Any claims, damages, or losses arising from such disputes are the responsibility of the involved parties.
• By using our services, you release LinkHQ from claims, damages, and demands of any kind related to disputes arising between users.
• In case of a dispute between Buyers and Sellers, the decision by LinkHQ will be final.

6. Intellectual Property

• Sellers retain ownership of their content but grant LinkHQ a non-exclusive license to display and distribute it on our platform.
• Users must not infringe on the intellectual property rights of others.

7. Prohibited Activities

• Violating any applicable laws.
• Posting false, misleading, or harmful content.
• Spamming, phishing, or unauthorized advertising.
• Engaging in fraudulent activities or transactions.

8. Payment and Fees

• Sellers are responsible for setting prices, taxes, and other fees for their offerings.
• LinkHQ collects fees for providing platform services. These fees are subject to change with prior notice.
• LinkHQ or the Sellers can cancel any user orders and refund the same for any reasons.

9. Dispute Resolution

For disputes related to platform usage, contact us at info@linkhq.co. LinkHQ encourages resolving issues amicably. We are not obligated to mediate or resolve disputes between Buyers and Sellers. However, in case of disputes, the decision by LinkHQ will be final.

10. Termination

• LinkHQ may suspend or terminate access to the platform for violations of these Terms or applicable laws.
• LinkHQ can delete accounts or remove products offered by Sellers at their discretion.
• Users may terminate their accounts by contacting info@linkhq.co.

11. Amendments

We reserve the right to amend these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts located in Kerala, India.

13. Disclaimer

• LinkHQ provides its services on an "as-is" basis without warranties of any kind.
• We disclaim liability for damages arising from the use of our platform.
